One-on-one Coaching Agreement

Coaching Agreement

Thank you for purchasing your own coaching package offered by Heartrise Healing and Coaching. This Agreement begins on the earlier of the day you provide your first payment or sign this Agreement, which is called our “Effective Date.” You are referred to as “Client” in this Agreement.

Program Format

1. This Agreement provides access to a specific number of sessions in the program purchased. The Program includes:

a. Access to the online portal available at https://heartrisesnow.com/ for the duration of the program;

b. Weekly, bi-weekly, monthly (Look within the purchase offer)

c. A series of one-on-one coaching sessions with (“Coach or healer/ing”), to be scheduled as provided for in this Agreement.

2. All sessions must be scheduled for a date that is within 90 days of the Effective Date of this Agreement. You will use the scheduling link available at https://heartrisesnow.com/ to book your sessions.

Unused sessions are forfeited at the expiration of the 90-day period, without refund.

3. Coaching sessions take place by phone or google meet at Client’s option, and the call or video session will be initiated by Coach.

4. This Agreement does not include done-for-you services of any kind. [This Agreement does not include access to Coach between sessions OR This Agreement includes limited access to Coach in between sessions by Voxer or text. Please review our Business Policies to learn more about response times, times off, and holiday schedules.]

Fees

5. Payment for the Program is at the option of the Client, as either one payment or [number of installments] recurring payments of (based on package purchased).

Cancellation and Rescheduling Policy

6. Twenty-four (24) hours’ notice by email or via the online calendar at https://heartrisesnow.com/ is required to reschedule. Failure to provide notice results in a forfeited session.

Confidentiality

7. Identifying information shared in coaching sessions is confidential and not shared outside the session by the Coach unless mutually agreed upon and documented in writing by Coach.

Confidentiality Exception: If Coach is required by law to make disclosure regarding the information shared in a coaching session, or where Coach has a good faith belief that disclosure of such information is necessary to comply with the law; or to protect Coach’s rights or property; to avoid harm to the Coach, Client, or a third party; or to respond to an emergency, Coach may disclose confidential information but will limit disclosure to essential information.

Additional Program Information

8. Occasionally the contents of the online portal and access to Coach may have to change based on Company needs, available technology, and factors outside the Company’s control. The Company will replace or substitute the items included in this Agreement, if it determines it is necessary to do so in its sole discretion, with something similar of equal or greater value.

9. Coaching will be provided by myself, Sylvia Del Angel or “a representative our team.”

10. Ownership of Written Materials. As a Program participant, you will have one non-exclusive, personal license to view written materials provided by Company. You do not have ownership of this information, which is protected by federal copyright laws. You may not copy, re-engineer, distribute, or otherwise provide access to this information to any other person, for free or paid, in whole or in part, without express written consent of Company, which it may withhold for any reason, and purchase of a license (prices start at $2,500.00). Failure to abide by this policy will result in termination of access to the materials and issuance of an invoice for the license fee.

11. Heartrise Healing and Coaching protects its names. You are not receiving permission to use trade and service marks of the Company, including its name or the Program name, or any other mark owned by the Company.

Termination

12. Client may choose to discontinue the coaching portion of the Program at any time, for any reason, subject to the refund policy in this Agreement.

13. Coach may discontinue the coaching relationship for the following reasons:

a. Client, if paying in installments, fails to make payment (by choice or because the payment method is canceled, declined, or otherwise unavailable) within 7 days of the due date. No refund shall issue in this circumstance and no further sessions shall be conducted and access to Program materials shall be revoked until the account is in good standing.

b. Coach determines, in its sole discretion and without requiring disclosure of the reason, that the relationship must terminate. In this circumstance, Coach will provide a pro-rated refund for each of the remaining sessions.

Refunds

14. By signing this Agreement, you acknowledge that no one has represented to you that refunds are available. Even if you cannot participate for any reason, you will continue to be billed according to the schedule in this Agreement until paid in full. Heartrise Healing and Coaching considers this policy a material inducement to entering into this Agreement, and would not have done so unless this No Refunds policy were included. If you initiate a chargeback, Heartrise Healing and Coaching may issue an additional $250 fee to you.]

Additional Legal Terms

15. This Agreement is made and shall be enforced according to the laws of the State of California without regard to its conflicts of law principles. Client agrees to submit to personal jurisdiction in Elk Grove, California, as the sole forum in the event of a dispute under this Agreement.

16. Any claims arising from this agreement for losses, costs, damages of any nature whatsoever or claims expenses from any cause or causes, including attorneys’ fees and costs, shall be limited to the amount paid hereunder.

17. This Agreement, our Business Policies (including access to Company) are the final and complete agreement between us, and any changes must be made in writing and signed by both parties. A waiver of one provision shall not be deemed a continuing waiver or a waiver of any other provision of this Agreement.

18. By signing this Agreement, Client agrees to its terms and acknowledges that he or she has read and understands the Disclaimer available at https://heartrisesnow.com/ and which is incorporated herein by reference.

CONSENT FOR VIRTUAL CONSULTATIONS and Services. Internet service may not always be private or safe and risks exist about attaining information. Information will be collected when subscribing but you can always unsubscribe anytime.

I understand that my Holistic Practitioners/Coaches wishes me to engage in a virtual consultation.
My Holistic Practitioners/Coaches will be utilizing video conferencing technology, It will not be the same as a direct visit due to the fact that I will not be in the same room as my Holistic Practitioners/Coaches. I understand that a virtual consultation/services has potential benefits including easier access and the convenience of meeting from a location of my choosing.
I understand there are potential risks to this technology, including interruptions, unauthorized access, and technical difficulties. I understand that my Holistic Practitioners/Coaches can discontinue the virtual consult/visit if it is felt that the videoconferencing connections are not adequate for the situation. By purchasing any program or consultation I acknowledge: Holistic Practitioners/Coaches are not therapy and are not Emergency Services. In the event of an emergency, I will use a phone to call 911.

HeartRise Healing and Coaching is not responsible for the delivery of any healthcare, medical advice or care.

To maintain privacy, I will not share my virtual appointment link with anyone unauthorized to attend the appointment.
